By making a purchase from, and using, this website you have agreed to these terms of use. We may need to update these Terms Of Use to add new terms that are relevant to our new improvements on our website, you can review the most current version of the Terms of Use at any time on this page Please spare few moments to read and understand these terms of use when using our website.

Use Of The Site

You must be 18 years or older to register for an Account, make purchases and by entering accessing, browsing, submitting information to, or otherwise using the site, you acknowledge and agree to the following terms and conditions. if you do not agree to these terms, please do not access or use the site.

Payment

You may pay with either credit or debit cards or Pay Pal. Stripe banking services manages all of our banking transactions. Surfcasual does not store any credit card numbers. Other than paying with Pay Pal, you may pay with your Visa, American Express or MasterCard securely in this site. Your payment is handled by Stripe. We have a SSL Certificate (Secure Socket Layer), therefore any transaction owing with secure encryption and under strict banking standards. Your card details are sent directly to the bank and cannot be read or accessed by anyone other than your bank. Surfcasual does not charge any extra costs for card payments. However, your bank may charge an additional fee depending on your card and bank. When paying by credit or debit card starting conditions apply as soon as the card transaction is approved. In the event that no payment has been received after submitting your order, Surfcasual may automatically cancel your order.

Product and Pricing

Surfcasual has the right to adjust prices and change product information such as product pictures and offers without notice. The product images and information texts available reflect the product as much as possible. We reserve the right for any errors that may appear on the page and cannot guarantee that all pictures accurately reflect the true appearance of the watch. The pictures may differ depending on the color settings in your computer. Thus, all pictures should be seen as illustrations only. If a price is incorrect, this may constrain Surfcasual to cancel the purchase and refund any amount paid in the best way. This can be performed at any time.

Ordering

Orders made in another person’s name without his approbation or otherwise, will be reported to the authorities. Surfcasual holds the right to change prices, correct incorrect prices on all orders as well as final sales. Consumers have the right to return the order within 30 days from receiving the order. The right applies only in the case that the product and its original packaging can be returned in the same condition as when received. If consumers use their right to send back an order they should contact Surfcasual in order to get an address to send the goods to. If an item is damaged during transport, Surfcasual should be contacted within 14 days for information about compensation.

Cancellations

The customer have the right to cancel purchases and return delivered goods by contacting Surfcasual’s customer service on e-mail: aloha@surfcasual.com within 30 days from receiving the goods, provided the goods are in the original package and in the same condition as when you received them. However, the customer is responsible for the cost and risk for transporting the returned goods to us. In cases, you as a customer believe that the delivery is delayed in such a way that you no longer wish to fulfill the order, it is your responsibility to cancel the order. In cases where the order has been dispatched, the customer is required to receive the order, and we might not be able to cancel transactions of shipped products. Cancellation is not valid until the customer has confirmed with Surfcasual by email. If a product has been discontinued Surfcasual has the right to cancel the purchase and refund the paid amount to the customer.

Complaints Terms

It is important that you as a customer carefully check your goods / products when you receive your shipment in order to verify that the products are not damaged and correct. If your product is damaged in transport, whether the damage is visible or hidden, you must report this as soon as possible to the carrier. If you receive your item and see that it is damaged or does not match the one you ordered or, you shall also contact us within 30 days from receiving the product. Any complaints shall be made to our customer service e-mail. Please supply the order number and the reason for complaint and we will get back to you shortly with instructions on how to return the item. Defective products returned to us should be treated as if they were faultless. It is in all types of returns extremely important that the product is packaged in such a way that it cannot be damaged during transit. In the case that a returned product has no errors or faults.

Liability

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. We do not warrant and we won’t be held responsible for lost,stolen, unreceived packages. We bear no direct or indirect responsibility for example, but not limited to, incompatibility, delivery delays, downtime, data loss, additional work or other economic harm.

Terminations

Surfcasual reserves the right to cancel any purchase if any suspicion of fraud is raised. We reserves the right to terminate your account and/or your use of the www.surfcasual.com website at its sole discretion. Such termination can be made without prior notice. We reserve the right to terminate your account, cancel any order, refuse or access to the Site to you or any other person or entity for any reason or for no reason whatsoever at any time, without notice or liability.

Mobile Terms of Service

The Surfcasual mobile message service (the “Service”) is operated by Surfcasual (“Surfcasual”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Surfcasual’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Surfcasual through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Surfcasual. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP and respond to the message or click the unsubscribe link (where available) in any text message to cancel. You’ll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Surfcasual mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

The site, the content and the products are services available on or through the site and the company are provided “as is” and “as available”, without any warranties or guarantees, express or implied. By using our services you agree to this document, the shipping policy, the return policy and other polices written on the Site even if they aren’t explicitly named policies.
